What is domestic violence?

Domestic violence is any threat or threat of an action by a family member against another member of the family that is intended to cause bodily injury or sexual assault, or a reasonable fear of such an action.

In the eyes of the law, child abuse, spousal abuse, and other forms of violence perpetrated by family members are considered domestic violence.

What is a protective order?

Any adult in the household can seek a protective order for themselves or for any other member of the household, including a child who is a victim of abuse. This order is meant to protect the victims of abuse by ordering the abuser to stop the abuse.

The Attorney General, the District Attorney, or the Department of Protective and Regulatory Services may also apply on behalf of anyone who is a victim of family violence.

In some cases, the victim's testimony may be enough to obtain a protective order, even in the absence of a police report. A protective order can order the abuser to:

  • Stop the abuse
  • Stop communicating with the victim
  • Stay away from the home or work of the victim
  • Stop harassing, annoying, alarming, abusing, or embarrassing the victim
  • Stay away from firearms

Violations of a protective order can result in criminal charges that range from a Class A misdemeanor to a third degree felony, depending on the violator's charge and criminal history.
