Information on Adoption in Texas
In order for an adoption to be finalized, the parental rights of at least
one of the birth parents must be terminated by the court. Once this is
completed, a petition for adoption must be filed with the court. If the
petitioner is married, both spouses will need to be on the petition.
Other requirements include:
- The child typically must live with the adoptive parents for at least six months.
- An ad litem may be appointed for the child.
- A criminal history check for the adoptive parents must be performed.
- A health, social, education, and genetic history report must be prepared
for the child, with the exception of stepparent adoptions.
Once the above steps are completed, a court hearing will be held to determine
if the adoption is in the child's best interests.
How are a birth parent's rights terminated?
The parental rights of a birth parent can be terminated by: 1) a voluntary
relinquishment by the birth parent signing an affidavit giving up their
rights, 2) an alleged father's failing to register with the state's
paternity registry, or 3) an involuntary termination where the court terminates
a parent-child relationship because it is in the child's best interests.
